RIT freshman Avery Bird has pleaded not guilty to charges of unlawful surveillance. Bird was arrested yesterday in connection with a hidden recording device in one of the bathrooms of Helen Fish B Hall.
Investigators say that the device was recording for two days.
According to 13WHAM, Bird was issued a modified order of protection, which allows him to attend classes and stay in his dorm. However, Bird is barred from common areas on campus or gender neutral bathrooms.
The same day as his arrest, Bird was released on his own recognizance, meaning he was released from custody without having to post bail. This is based on a formal promise that Bird will agree to return to court for all scheduled hearings.
Yesterday, the RIT community received an email titled “Recording Device Discovered,” explaining the incident. While the email stated that “the individual has been removed from the RIT community,” it’s unclear whether this means expulsion.

An RIT student was arrested today in connection with a hidden recording device found in one of residence hall’s Helen Fish B’s bathroom.
On Sept. 18, RIT Public Safety discovered the device and notified the Monroe County Sheriff’s Department, and an investigation was launched. It was found that the device was set up on the evening of Sept. 16.
Additionally, Public Safety conducted a “broad search” of campus, in which no additional devices were found.
The student was charged with Unlawful Surveillance in the Second Degree — a Class E felony.
The student was taken to the Monroe County Jail to await arraignment in Centralized Arraignment Part Court.
Today, an email titled “Recording Device Discovered” was sent out to the RIT community, explaining the incident.
“The discovery of a recording device in a restroom is a serious violation of privacy and of the trust that our community places in one another,” the email stated.
